1. Elvis' name is misspelled on his tombstone. Elvis' full name is Elvis 'Aron' Presley..., not Elvis 'Aaron' Presley. His father would not have let this happen. When Elvis was born, his name was misspelled on his birth certificate and his father went to great lengths to get the error corrected. The spelling of Elvis' name was very important to the Presley family. They wanted Elvis to see that Aron was part of Garon (Garon is the middle name of Elvis' twin brother that was stillborn). Why the misspelling on the tombstone? Some say it is because Elvis did not want to temp
t fate.
2. Elvis' current resting place is in between his father and his grandmother and not next to his mother where he had adamantly requested. It is doubtful that the people close to him would allow these things to happen. Elvis is a superstitious man - enough so that he wouldn't tempt fate by putting his real name on a tombstone, or violate the ground next to his mother until he was ready to be placed there for good.
3. Elvis was very vain, and he was embarrassed about his recent weight gain - An astonishing 50 pounds in the month before his so-called death. Even though he weighed 250 pounds at the time of his death, his death certificate lists him at a spry 170 pounds. The original death certificate disappeared, and the current death certificate is dated two months after his alleged death.
4. Elvis' coffin required several pall bearers because it weighed 900 pounds. Attendants at the funeral reported that the air around the coffin was rather cool. It is suspected that the coffin contained an air conditioning unit or dry ice to keep a wax body cool. A wax body that was a replica of Elvis designed to fool funeral- goers. And how did the Presley family get a 900 pound, custom made coffin ready for the showing of the body that was held on the day after his death? It takes a lot of time to build such an elaborate coffin. Alanna Nash, formerly of the Louisville Courier-Journal, who viewed the body in the casket twice, commented on how wax-like it looked. La Costa, sister of Tanya Tucker, said, "We were right up to the casket and stood there, and God, I couldn't believe it. He looked just like a piece of plastic laying there. He didn't look like Elvis at all... He looked more like a dummy than a real person."
5. And why have the funeral so quickly? Some speculate that the immediacy was intended to make it as difficult as possible for the people who were Elvis' biggest fans (heads of fan clubs, etc.) to attend the proceedings. It could be a concern that they might recognize the flaws in the wax replica..., many of which were noticed anyway.
6. Elvis was an 8th degree black belt whose hands were rough with calluses, yet the body in the coffin had hands that were soft and pudgy. The body in the coffin had a pug nose and arched eyebrows (unlike Elvis) and most importantly, one of the sideburns on the corpse was loose and falling off. A hairdresser later reported gluing the sideburn back on the body.
7. Two hours after Elvis' death was announced publicly, a man who reportedly looked remarkably like Elvis purchased a ticket for Buenos Aeries, paid in cash, and used the name John Burrows: the name Elvis had used as an alias several times before.
8. He had a few books that were considered to be his most prized possessions. He had a Bible, several pharmaceutical books, books on death, and most importantly Cheiro's Book of Numbers and the Autobiography of a Yogi. After his death was announced, these books disappeared and were never recovered. Also missing were specific pieces of jewelry and pictures of his mother.
9. In the weeks preceding his alleged death, Elvis' actions were not those of a man who was about to embark on an extensive US tour. He ordered no new suits despite having gained 50 pounds since his last tour.
10. Elvis fired several employees that he had relied upon for a long time.
11. Two days before his alleged death, Elvis telephoned a friend of his named Miss Foster (Elvis had been friends with her for a long time because she reminded him of his mother). He told her that he wasn't planning on going on the upcoming tour. She asked him if he had canceled it, and he said that he had not. When she asked if he was ill, he said that he was fine, and that she should not ask any more questions or tell anyone anything, and that she should not believe anything she reads. He told her that his troubles would all soon be over, and that he would call her in a few weeks. The author of 'Elvis Where Are You?' writes that Miss Foster took a polygraph test regarding this story, and that she was not lying.
12. The day after Elvis' alleged death, a woman named Lucy De Barbon, a former lover of Elvis', received a single rose in the mail. The card indicated that the flower was from "El Lancelot". This had been her pet name for Elvis, and it was a name that no one else knew. Flowers can't be sent from beyond the grave.
13. Elvis had many reasons to fake his death. Elvis' life was in danger. He had recently lost $1,300,000 in an airplane/real estate deal with a California based organization called the "Fraternity" that had links to the Mafia. It is speculated that he corroborated with the government to expose the organized crime ring in exchange for protection - perhaps in the form of a new life and identity compliments of the witness relocation program.
14. Elvis was a prisoner of his own fame. He had many other reasons to leave his life behind. Because of his incredible popularity, he was the recipient of several death threats, and he was concerned about the safety of his ex-wife and daughter. Sometimes when he wanted to leave Graceland, he would send out look-alikes to distract would be followers. Elvis was also known to ride in the trunk of someone else's car to avoid detection.
15. Elvis had the means to fake his own death. He is accused of destroying himself with drugs. In reality, Elvis was a pharmaceutical expert. He took a lot of drugs, but he knew what he was doing and was extremely careful. He knew what drugs he could self- administer to create a deathlike state. Further, Elvis' experience with the martial arts was such that he could slow his heart rate and breathing in order to feign death. He was an eighth degree black belt.
16. Elvis' manager, Colonel Tom Parker, had once created a new identity for himself. He came to this country as an illegal immigrant from Holland, but through various connections managed to create an elaborate identity complete with a passport, birth certificate, drivers' license, and social security number. He would have known how to give Elvis a second life.
17. Elvis' Lloyds of London life insurance policy still has not been cashed in. Why? It is not illegal to fake your death as long as you don't profit from it.
18. There was a helicopter hovering over Graceland just moments before Elvis was found dead. Did Elvis get on that helicopter? Did the helicopter drop off another body to take Elvis' place? Monte Nicholson, a veteran with the Los Angeles Sheriff's Dept., writes in his novel The Presley Arrangement about a government helicopter hovering over Graceland, and finally landing in the back. Nicholson was informed there were pictures of Elvis getting on the helicopter during the early afternoon of August 16. Others report seeing a helicopter - including Larry Geller in his book If I Can Dream: Elvis' Own Story, who says he saw from his window at Howard Johnson's: helicopters hovering over Graceland.
19. According to handwriting experts, Elvis' own handwriting was on his death certificate/coroners report.
20. Some of Elvis' closest friends were asked, by Vernon, not to attend the funeral.
21. Elvis' father refused to have his son's coffin draped with the American flag, traditionally given to all dead veterans. Did he know that the coffin did not contain his son's body?
22. In December 1970, Elvis was inducted into the Drug Enforcement Agency (DEA) by President Nixon. Elvis had just been awarded one of America's Ten Outstanding Young Men for his efforts to wipe out drugs. Elvis went undercover for the DEA and helped put one of America's largest crime rings behind bars. This particular undercover operation was coded 'Operation Fountain Pen'. Was Elvis really addicted to drugs..., or was he the ultimate actor after all? The U.S. Department of Justice's Federal Bureau of Investigation in Washington confirmed in a letter to Maria Columbus, president of The Elvis Special fan club, that Presley visited FBI headquarters on December 31, 1970 and was given a tour of FBI facilities. Two months prior to meeting with President Nixon, Elvis was presented with a CNOA Membership Certificate that reads: This is to certify that Elvis A. Presley is a member in good standing of the California Narcotics Officers Association. Once when Elvis was on stage, he wanted to prove to the audience that he was not strung out on drugs like everyone said he was. He then displayed a certificate to the audience and said, "This if from the International Narcotics Enforcement Association. This Certificate gives me special honors and a lifelong membership. I've been wearing a federal narcotics badge for six years. They don't give you that if you're strung out." One of the fan letters states that several police uniforms were delivered to Graceland on August 15, 1977.
23. The Elvis estate demanded that no cameras be brought to the funeral.
24. One month prior to August 1977..., $1,000,000.00 was withdrawn from his personal checking account.
25. The medical examiner's report says that the body was found in the bathroom in a rigor-mortised condition. The homicide report says that the body was found in the bedroom 'unconscious'.
26. What about the tape - authenticated - that was sent to a top voice-identification expert, on which Elvis talked about things that did not occur before August 1977?
27. What about the mind-boggling picture taken in the poolhouse behind Graceland's Meditation Gardens four months after the death of Presley and showing a man seated who looked exactly like Elvis? Mike Joseph took this photograph in January 1978 while on vacation and visiting Meditation Gardens. There is an audio recording of Mike Joseph stating that the person in that photograph is Elvis. Later, after a meeting with Joe Esposito and Al Strada, he changed his story. Now he says that he never stated that it was Elvis in the photograph even though he was recorded as saying it was.
28. "I may not look good tonight, but I'll look good in my coffin," said Presley on his last concert tour, 1977. At a different time he said, "I know I look fat now and I'll look terrible for my TV special coming up. But I'll tell you this: I'll look good in my casket."
29. "If I should return you would not recognize me" is underlined in one of Elvis' favorite books.
30. In 'Elvis, My Brother', Billy Stanley noted that Elvis was wearing a jogging suit with the DEA logo during the early morning hours of August 16, 1977.
31. There are 663 FBI pages on Elvis, much of the material consists of files dated after August 1977.
32. Phone records show that Ginger Alden, Elvis' girlfriend at the time of his alleged death, phoned the National Enquirer one to three hours before calling downstairs for help when she found Elvis in the bathroom floor. How did she know to call them one to three hours before there was anything to call about? Did she know that there was going to be a body in there later in the day?
33. What about the sightings, many by very credible people?
34. Elvis believed that he was chosen by God for something special. He thought he had special powers like, hands-on-healing. I think he may have had some special gifts other than his voice. Elvis was always studying about religion. He didn't want to take any chances when it came to getting into the Kingdom of Heaven. One of his favorite books, which you will find on display at Graceland now, was The Passover Plot by Hugh Schonfield in 1966. The book is a story of how Jesus may have faked his death and came back 16 years later instead of being resurrected. Elvis may have faked his death and given up all worldly possessions in an effort to make it into the Kingdom of Heaven. Elvis once mentioned to a friend that he would like to become a Monk. After August 16, 1977, a man dressed as a Monk went into a popular entertainment club. Another customer reported that the face under the hood looked remarkably like Elvis Presley. As it turns out, the club was owned by a good friend of Elvis'.
35. There were orders by the Presley Estate that no cameras be brought to the funeral. However, one of Elvis' relatives, Bobby Mann, managed to sneak one in. The picture he took appeared on the front of the National Enquirer. It is evident in the picture that it is not Elvis Presley.
36. Elvis was pronounced dead at 2:56 PM. Between that time and when the body was viewed the next day, there seemed to be enough time to do all of the following: Autopsy and embalming were completed, the body was back at Memphis Funeral Home around 8:00 PM, sixteen white limousines were ordered, a white Cadillac hearse was readied, a specially designed casket was ordered and flown in, a casket blanket of 500 red roses was made, the security and police were ordered, the tour was canceled, personal calls were made by Vernon to fan club presidents asking that they not attend, clothing was chosen, songs were chosen, ministers contacted, the procession planned, and the body was put on private display by 11:30 the next morning.
37. Dee Presley, Elvis' stepmother, said she received a call from someone sounding like Elvis, saying things only Elvis knew.
38. A picture taken September 23, 1984 shows Muhammad Ali, Reverend Jesse Jackson, and what appears to be Elvis Presley. When Muhammad Ali was in Fort Worth, Texas, toward the end of 1989, promoting his cologne, two people showed him the picture. As reported by the Fort Worth Star-Telegram, Ali identified the man in the picture with him as "My friend Elvis." Also, in late 1989, a lady showed the picture to Elvis' step-brother, Billy Stanley. Billy pointed the man out as being Elvis Presley. He said he wanted a copy of the picture to put on his office wall to prove that Elvis was not a racist.

Many believe that Elvis couldn't have given up performing cold turkey. I imagine that after a while the desire to perform grew once he started his life in exile. The story of Orion supports the theory that Elvis attempted an incognito comeback. Shortly after Elvis's death, a masked singer by the name of Orion emerged on the scene. He was big like Elvis, and he sang just like Elvis. Because of the mask, no one could tell his true identity. One fan described seeing Orion from near the stage. She claims that Orion left the stage between songs, and when he appeared moments later the sweat was gone from his armpits and back and she thought that his costume looked slightly different. After the song he left the stage, and the original Orion returned. Another fan described how she rushed into a tour bus at an Orion show only to see two Orions in the back of the bus. She claimed that one ducked into the bathroom before she could get a good look at him, but he appeared to look like Elvis Presley. What's even more remarkable is the fictional story called Orion that was written by Gail Brewer-Georgio about a legendary performer who had several identities and wanted to fake his death. The story was written and submitted to the William Morris Agency for publication consideration after Elvis's death and before the real Orion ever performed. As it turns out, there are many ways in which the real Orion mimicked the events as described in the book. For example, the performers' managers had the same name. Also, without knowing it, Brewer-Georgio wrote of events in Orion that had actually taken place in Elvis Presley's life. It was a case of life imitating art.
Picking up the Pieces.
In 1981, 20/20 did an investigation into the circumstances surrounding the alleged death of Elvis Presley. The investigative report was very convincing. Oddly enough, within two weeks of the report, the singer, Orion, disappeared and was never heard from again. The book, Orion disappeared from shelves across the country. It had been recalled by the publisher which was associated with the William Morris Agency. Incidentally, the William Morris Agency is the same agency that represented Elvis Presley. I even tried to order a copy of the book, but was unable to. The woman at the book store said she couldn't tell me why....... It seems that Elvis Presley is worth more dead than alive. By faking his death and relocating with a new identity, he is safe from his fans and the Fraternity, the government can make a solid case against the organized crime ring, and RCA, Elvis's family, and Elvis's management can all reap immense financial benefits from the attention. That is... except for one benefit. No one has collected on his life insurance policy.

I, Elvis A. Presley, a resident and citizen of Shelby County, Tennessee, being of sound mind and disposing memory, do hereby make, publish and declare this instrument to be my last will and testament, hereby revoking any and all wills and codicils by me at any time heretofore made.
Item I
Debts, Expenses and Taxes
I direct my Executor, hereinafter named, to pay all of my matured debts and my funeral expenses, as well as the costs and expenses of the administration of my estate, as soon after my death as practicable. I further direct that all estate, inheritance, transfer and succession taxes which are payable by reason under this will, be paid out of my residuary estate; and I hereby waive on behalf of my estate any right to recover from any person any part of such taxes so paid. My Executor, in his sole discretion, may pay from my domiciliary estate all or any portion of the costs of ancillary administration and similar proceedings in other jurisdictions.
Item II
Instruction Concerning Personal Property: Enjoyment in Specie
I anticipate that included as a part of my property and estate at the time of my death will be tangible personal property of various kinds, characters and values, including trophies and other items accumulated by me during my professional career. I hereby specifically instruct all concerned that my Executor, herein appointed, shall have complete freedom and discretion as to disposal of any and all such property so long as he shall act in good faith and in the best interest of my estate and my beneficiaries, and his discretion so exercised shall not be subject to question by anyone whomsoever. I hereby expressly authorize my Executor and my Trustee, respectively and successively, to permit any beneficiary of any and all trusts created hereunder to enjoy in specie the use or benefit of any household goods, chattels, or other tangible personal property (exclusive of choses in action, cash, stocks, bonds or other securities) which either my Executor or my Trustees may receive in kind, and my Executor and my Trustees shall not be liable for any consumption, damage, injury to or loss of any tangible property so used, nor shall the beneficiaries of any trusts hereunder or their executors of administrators be liable for any consumption, damage, injury to or loss of any tangible personal property so used.
Item III
Real Estate
If I am the owner of any real estate at the time of my death, I instruct and empower my Executor and my Trustee (as the case may be) to hold such real estate for investment, or to sell same, or any portion therof, as my Executor or my Trustee (as the case may be) shall in his sole judgment determine to be for the best interest of my estate and the beneficiaries thereof.
Item IV
Residuary Trust
After payment of all debts, expenses and taxes as directed under Item I hereof, I give, devise, and bequeath all the rest, residue, and remainder of my estate, including all lapsed legacies and devices, and any property over which I have a power of appointment, to my Trustee, hereinafter named, in trust for the following purposes: (a) The Trustees is directed to take, hold, manage, invest and reinvent the corpus of the trust and to collect the income therefrom in accordance with the rights, powers, duties, authority and discretion hereinafter set forth. The Trustee is directed to pay all the expenses, taxes and costs incurred in the management of the trust estate out of the income thereof. (b) After payment of all expenses, taxes and costs incurred in the management of the expenses, taxes and costs incurred in the management of the trust estate, the Trustee is authorizes to accumulate the net income or to pay or apply so much of the net income and such portion of the principal at any time and from time to time to time for health, education, support, comfortable maintenance and welfare of: (1) My daughter, Lisa Marie Presley, and any other lawful issue I might have, (2) my grandmother, Minnie Mae Presley, (3) my father, Vernon E. Presley, and (4) such other relatives of mine living at the time of my death who in the absolute discretion of my Trustees are in need of emergency assistance for any of the above mentioned purposes and the Trustee is able to make such distribution without affecting the ability of the trust to meet the present needs of the first three numbered categories of beneficiaries herein mentioned or to meet the reasonably expected future needs of the first three classes of beneficiaries herein mentioned. Any decision of the Trustee as to whether or not distribution, to any of the persons described hereunder shall be final and conclusive and not subject to question by any legatee or beneficiary hereunder. (c) Upon the death of my Father, Vernon E. Presley, the Trustee is instructed to make no further distributions to the fourth category of beneficiaries and such beneficiaries shall cease to have any interest whatsoever in this trust. (d) Upon the death of both my said father and my said grandmother, the Trustee is directed to divide the Residuary Trust into separate and equal trusts, creating one such equal trust for each of my lawful children then surviving and one such equal trust for the living issue collectively, if any, of any deceased child of mine. The share, if any, for the issue of any such deceased child, shall immediately vest in such issue in equal shares but shall be subject to the provisions of Item V herein. Separate books and records shall be kept for each trust, but it shall not be necessary that a physical division of the assets be made as to each trust. The Trustee may from time to time distribute the whole or any part of the net income or principal from each of the aforesaid trusts as the Trustee, in its uncontrolled discretion, considers necessary or desirable to provide for the comfortable support, education, maintenance, benefit and general welfare of each of my children. Such distributions may be made directly to such beneficiary or to the guardian of the person of such beneficiary and without repsonsibilty on my Trustee to see to the application of nay such distributions and in making such distributions, the Trustee shall take into account all other sources of funds known by the Trustee to be available for each respective beneficiary for such purpose. (e) As each of my respective children attains the age of twenty-five (25) years and provided that both my father and my grandmother are deceased, the trust created hereunder for such child care terminate, and all the remainder of the assets then contained in said trust shall be distributed to such child so attaining the age of twenty-five (25) years outright and free of further trust. (f) If any of my children for whose benefit a trust has been created hereunder should die before attaining the age of twenty- five (25) years, then the trust created for such a child shall terminate on his death, and all remaining assets then contained in said trust shall be distributed outright and free of further trust and in equal shares to the surviving issue of such deceased child but subject to the provisions of Item V herein; but if there be no such surviving issue , then to the brothers and sisters of such deceased child in equal shares, the issue of any other deceased child being entitled collectively to their deceased parent's share. Nevertheless, if any distribution otherwise becomes payable outright and free of trust under the provisions of this paragraph (f) of the Item IV of my will to a beneficiary for whom the Trustee is then administering a trust for the benefit of such beneficiary under provisions of this last will and testament, such distribution shall not be paid outright to such beneficiary but shall be added to and become a part of the trust so being administered for such beneficiary by the Trustee.
Item V
Distribution to Minor Children
If any share of corpus of any trust established under this will become distributable outright and free of trust to any beneficiary before said beneficiary has attained the age of eighteen (18) years, then said share shall immediately vest in said beneficiary, but the Trustee shall retain possession of such share during the period in which such beneficiary is under the age of eighteen (18) years, and, in the meantime, shall use and expend so much of the income and principal for the care, support, and education of such beneficiary, and any income not so expended with respect to each share so retained all the power and discretion had with respect to such trust generally.
Item VI
Alternate Distributees
In the event that all of my descendants should be deceased at any time prior to the time for the termination of the trusts provided for herein, then in such event all of my estate and all the assets of every trust to be created hereunder (as the case may be) shall then distributed outright in equal shares to my heirs at law per stripes.
Item VII
Unenforceable Provisions
If any provisions of this will are unenforceable, the remaining provisions shall, nevertheless, be carried into effect.
Item VIII
Life Insurance
If my estate is the beneficiary of any life insurance on my life at the time of my death, I direct that the proceeds therefrom will be used by my Executor in payment of the debts , expenses and taxes listed in Item I of this will, to the extent deemed advisable by the Executor. All such proceeds not so used are to be used by my Executor for the purpose of satisfying the devises and bequests contained in Item IV herein.
Item IX
Spendthrift Provision
I direct that the interest of any beneficiary in principal or income of any trust created hereunder shall not be subject to claims of creditors or others, nor to legal process, and may not be voluntarily or involuntarily alienated or encumbered except as herein provided. Any bequests contained herein for any female shall be for her sole and separate use, free from the debts, contracts and control of any husband she may ever have.
Item X
Proceeds From Personal Services
All sums paid after my death (either to my estate or to any of the trusts created hereunder) and resulting from personal services rendered by me during my lifetime, including, but not limited to, royalties of all nature, concerts, motion picture contracts, and personal appearances shall be considered to be income, notwithstanding the provisions of estate and trust law to the contrary.
Item XI
Executor and Trustee
I appoint as executor of this, my last will and testament, and as Trustee of every trust required to be created hereunder, my said father. I hereby direct that my said father shall be entitled by his last will ant testament, duly probated, to appoint a successor Executor of my estate, as well as a successor Trustee or successor Trustees of all the trusts to be created under my last will and testament. If, for any reason, my said father be unable to serve or to continue to serve as Executor and/or as Trustee, or if he be deceased and shall not have appointed a successor Executor or Trustee, by virtue of his last will and testament as stated -above, then I appoint National Bank of Commerce, Memphis, Tennessee, or its successor or the institution with which it may merge, as successor Executor and/or as successor Trustee of all trusts required to be established hereunder. None of the appointees named hereunder,including any appointment made by virtue of the last will and testament of my said father, shall be required to furnish any bond or security for performance of the respective fiduciary duties required hereunder, notwithstanding any rule of law to the contrary.
Item XII
Powers, Duties, Privileges and Immunities of the Trustee Except
as otherwise stated expressly to the contrary herein, I give and grant to the said Trustee (and to the duly appointed successor Trustee when acting as such) the power to do everything he deems advisable with respect to the administration of each trust required to be established under this, my last will and Testament, even though such powers would not be authorized or appropriate for the Trustee under statutory or other rules of law. By way of illustration and not in limitation of the generality of the foregoing grant of power and authority of the Trustee, I give and grant to him plenary power as follows: (a) To exercise all those powers authorized to fiduciaries under the provisions of the Tennessee Code Annotated, Sections 35-616 to 35-618, inclusive, including any amendments thereto in effect at the time of my death, and the same are expressly referred to and incorporated herein by reference. (b) Plenary power is granted to the Trustee, not only to relieve him from seeking judicial instruction, but to the extent that the Trustee deems it to be prudent, to encourage determinations freely to be made in favor of persons who are the current income beneficiaries. In such instances the rights of all subsequent beneficiaries are subordinate, and the Trustee shall not be answerable to any subsequent beneficiary for anything done or omitted in favor of a current income beneficiary may compel any such favorable or preferential treatment. Without in anywise minimizing or impairing the scope of this declaration of intent, it includes investment policy, exercise of discretionary power to pay or apply principal and income, and determination principal and income questions; (c) It shall be lawful for the Trustee to apply any sum that is payable to or for the benefit of a minor (or any other person who in the Judgment of the Trustee, is incapable of making proper disposition thereof) by payments in discharge of the costs and expenses of educating, maintaining and supporting said beneficiary, or to make payment to anyone with whom said beneficiary resides or who has the care or custody of the beneficiary, temporarily or permanently, all without intervention of any guardian or like fiduciary. The receipt of anyone to whom payment is so authorized to be made shall be a complete discharge of the Trustees without obligation on his part to see to the further application hereto, and without regard to other resource that the beneficiary may have, or the duty of any other person to support the beneficiary; (d) In Dealing with the Trustee, no grantee, pledge, vendee, mortgage, lessee or other transference of the trust properties, or any part therof, shall be bound to inquire with respect to the purpose or necessity of any such disposition or to see to the application of any consideration therefore paid to the Trustee.
Item XIII
Concerning the Trustee and the Executor
(a) If at any time the Trustee shall have reasonable doubt as to his power, authority or duty in the administration of any trust herein created, it shall be lawful for the Trustee to obtain the advice and counsel of reputable legal counsel without resorting to the courts for instructions; and the Trustee shall be fully absolved from all liability and damage or detriment to the various trust estates of any beneficiary thereunder by reason of anything done, suffered or omitted pursuant to advice of said counsel given and obtained in good faith, provided that nothing contained herein shall be construed to prohibit or prevent the Trustee in all proper cases from applying to a court of competent jurisdiction for instructions in the administration of the trust assets in lieu of obtaining advice of counsel. (b) In managing, investing, and controlling the various trust estates, the Trustee shall exercise the judgment and care under the circumstances then prevailing, which men of prudence discretion and judgment exercise in the management of their own affairs, not in regard to speculation, but in regard to the permanent disposition of their funds, considering the probable income as well as the probable safety of their capital, and, in addition, the purchasing power of income distribution to beneficiaries. (c) My Trustee (as well as my Executor) shall be entitled to reasonable and adequate and adequate compensation for the fiduciary services rendered by him. (d) My Executor and his successor Executor and his successor Executor shall have the same rights, privileges, powers and immunities herein granted to my Trustee wherever appropriate. (e) In referring to any fiduciary hereunder, for purposes of construction, masculine pronouns may include a corporate fiduciary and neutral pronouns may include an individual fiduciary.
Item XIV
Law Against Perpetuities
(a) Having in mind the rule against perpetuities, I direct that (notwithstanding anything contained to the contrary in this last will and testament) each trust created under this will (except such trust created under this will (except such trusts as have heretofore vested in compliance with such rule or law) shall end, unless sooner terminated under other provisions of this will, twenty-one (21) years after the death of the last survivor of such of the beneficiaries hereunder as are living at the time of my death; and thereupon that the property held in trust shall be distributed free of all trust to the persons then entitled to receive the income and/or principal therefrom, in the proportion in proportion in which they are then entitled to receive such income. (b) Notwithstanding anything else contained in this will to the contrary, I direct that if any distribution under this will become payable to a person for whom the Trustee is then administering a trust created hereunder for the benefit of such person, such distribution shall be made to such trust and not to the beneficiary outright, and the funds so passing to such trust shall become a part thereof as corpus and be administered and distributed to the same extent and purpose as if such funds had been a part of such a trust at its inception.
Item XV
Payment of Estate and Inheritance
Taxes Notwithstanding the provisions of Item X herein, I authorize my Executor to use such sums received by my estate after my death and resulting from my personal services as identified in Item X as he deem necessary and advisable in order to pay the taxes referred to in Item I of my said will.
